TERMS AND CONDITIONS

For all orders explicitly apply the following terms and conditions

§ 1. Supply and services
All deliveries and services based on online orders in the internet are subject to these terms and conditions. Differing and / or supplementary agreements require the express consent of Juwelier Pernter KG and the written form. A valid sale contract is created by the customers order and our acceptance of the order (for example by telephone, by e-mail or by ordering from our online shop www.juwelierpernter-shop.com).

Juwelier Pernter KG is official retailer of HARLEY DAVIDSON by Bulova, BULOVA, BERING, CASIO, CITIZEN, FESTINA, LOTUS SMARTWATCH by Festina, GREENTIME by Zzero and POLAR. All products in our Online Shop are original products and will be shipped in the original packaging including the original guarantee of the manufacturer, instruction booklet and the receipt of our shop.

§ 2. Orders online
Juwelier Pernter KG will handle incoming online orders as fast as possible and ship promptly. All articles in our online shop are IN STOCK (if not otherwise specified in the article description). Delivery dates are not binding.

§ 3. Prices
Our prices are expressed in EURO (€), they contain the legal VAT and do not include shipping costs. In our online shop we try to guarantee long-term prices. However, price corrections upward and downward are possible, if this becomes necessary. The current price at the time the order is set, will be binding. Juwelier Pernter KG reserves the right to change prices without prior notice.

§ 4. Payments
Payments can be made either by cash on delivery (only for deliveries to addresses situated in Italy and the shipping fee for cash on delivery is 20,00 Euro) or as advanced payment by bank transfer or PayPal (for deliveries to addresses in all EU countries). The merchandise will be shipped one business day after receipt of the payment. You'll get your ordered items with the receipt of our Shop. Orders are to pay within 7 days and without any deduction unless other payment arrangements have been agreed. From 30 days after the order date Juwelier Pernter KG is entitled to charge interest for default at a rate of 3% above the discount rate. Offsetting is permissible only with undisputed or legally established claim. The customer can only claim a lien so far as it is based on the same contractual relationship.

We are a retail company and therefore we only sell to end users. For all puchases made, the corresponding receipts from our shop are issued and enclosed with the order when it is dispatched.

§ 5. Object of purchase and ownership
The purchase remains property of Juwelier Pernter KG until to full payment.

§ 6. Shipping
We ship exclusively with isured shipment with Express Courier Bartolini BRT and only in all EU countries. We ship 1 day after the payment has come in. Please make sure that there is someone at the delivery address to receive the parcel. The delivery must be checked on receiving for completeness and eventual damage. For complaints due to damage the customer has to claim directly against the shipping company within the terms intended and also to inform Juwelier Pernter KG. We like to emphasize that delivery times do not depend on us.

§ 7. Complaints
Complaints about defective delivery, material defects and quantity discrepancies must be reported immediately in the written form, the latest however within one week of receiving the goods. For legitimate claims Juwelier Pernter KG will send the missing goods, exchange the goods, take them back or give a discount to the buyer. In case of exchanging the goods the second replacement is defective, the buyer has the right to rescind the purchase contract.

§ 8. Returns
We accept returns within 14 days after delivery. For return of goods the buyer requires a return authorization number and a copy of the invoice. Please contact us BEFORE sending back anything. We will give you a valid return authorization number. Returns without a return authorization number will not be accepted but returned immediately to the buyer on his own cost. The buyer bears the costs and risks for returns. Wrong deliveries are only accepted in undamaged, not labeled condition, in all parts complete and in original packaging. Returns will only be accepted if the defect of the goods have been pre-announced. Juwelier Pernter KG reserves the right to control the products. If the merchandise is returned without authorization as defective to the seller, Juwelier Pernter KG will charge up to the customer 50,00 Euro plus shipping costs for testing the products. Juwelier Pernter KG reserves the right to replace or refund a returned defective product with an identical or equivalent product.

§ 9. Non-acceptance of goods
Ordered and unaccepted goods entitle Juwelier Pernter KG to terminate the contract. The seller is also authorized to claim for damages amounting to 20% of net order value and processing costs in the amount of 12.40 EURO plus VAT. A claim for damages comes to bear even if the customer doesn't keep the legal withdraw period to resign from the contract in written form. A purchase contract is concluded when sending the online order. The buyer accepts the terms and conditions of ordering by mailing the order.

§ 10. Revocation
The buyer may return the product within 14 days. The period begins with receipt of the goods. The revocation of the order should occur in written form or by return of the goods. When the revocation occurs in written form it will be sufficient keeping the deadline to mantain the revocation. Upon receipt of the returned merchandise the purchase price will be refunded. Shipping costs are entirely borne by the buyer.

§ 11. Warranty, liability and warranty repairs
According to the Legislative Decree No. 24 of February 2, 2002, the warranty period is 24 months from date of purchase. Products are sold to the guarantee conditions of the manufacturer. Service and warranty services for these products are covered by the manufacturers themselves and run in one of its service centers. The seller assumes no liability for consequential damages caused by defective products or late deliveries.

§ 12. Vouchers
Juwelier Pernter KG can issue vouchers to its customers. Following conditions apply for all vouchers: all coupons are to be redeemed in the specified time limits; cash or credit account of the voucher amount is excluded. Each voucher can only be redeemed once per customer.

§ 13. Electronic Data Storage
Under the business relationship Juwelier Pernter KG is entitled to collect the customer's personal data, to store and process information. Disclosure to third parties of personal data will not be consummated.

§ 14. Privacy
Your data will be processed in compliance with the General Data Protection Regulation (GDPR) n. 679/2016. For more information please go to the top of this page and click on "Privacy" in the dark blue frame. Responsible for the treatment of data is Juwelier Pernter of Pernter Peter & Co. KG, Via Kennedy 154, 39055 Laives (Italy).

§ 15. Jurisdiction
The court in Bolzano / Italy is responsible for complaints.

§ 16. Dispute Resolution
For the consumer disputes arising out of this contract in connection with the online sale of goods and services between Juwelier Pernter SAS and the consumer, we already guarantee our participation in the Alternative Dispute Resolution Procedure at the ADR office "Onlineschlichter.it": Zwölfmalgreiner Strasse, 2 - 39100 Bozen (BZ) Italy - Tel. 0471 975597 - Fax 0471 979914

§ 17. Other
Errors, technical errors and typos are reserved.

Consumer Information according distance selling regulations
When making an order by e-mail / telephone / fax or letter, which neither affects your commercial or self-employed activity, please note the following law prescribed instructions.
1. Our standard terms of delivery are valid for shipments within all EU-countries. We ship only to all EU-countries.
2. If not otherwise specified the product prices always include the VAT valid in Italy of 22%.
3. In our online Shop you have the possibility to pay with cash on delivery (only and exclusively for deliveries to addresses situated in Italy and with a surcharge of € 10.00 plus shipping charges) or by advance payment by bank transfer or PayPal (VISA / Mastercard) for deliveries to addresses situated in all EU countries.
4. It apply the specified shipping instructions and shipping costs.
5. The purchase agreement becomes effective upon sending an order and receiving the goods. Our standard terms of delivery and consumers information have to be accepted before completing the ordering process, otherwise it will not be possible to make an order.
6. As consumer you have the option of returning the goods ordered within 14 days. The period begins with receipt of the goods and this instruction. The timely dispatch of goods will be sufficient to meet the deadline.
7. Returns will be at the expense and risk of the buyer.
8. In case of return of goods please send them back postage paid. When sending back your returns please indicate the bill number, the return authorization number and your address.
